Terms of service
Welcome to Dailys. These Terms and Conditions (the “Terms”) govern your use of dailys.ph and the related services we provide (together, the “Service”). Please read them carefully. By creating an account, completing a quiz, booking a consultation, or placing an order, you agree to these Terms.
1. About Dailys
Dailys is a Philippine direct-to-consumer telehealth brand focused on hair regrowth. The Service is operated by Dailys (the “Company,” “we,” “us,” or “our”).
Prescription medications offered through the Service are dispensed by our licensed Philippine pharmacy partner, which holds a valid Philippines Food and Drug Administration (FDA) License to Operate (LTO).
2. Eligibility
The Service is intended only for Filipinos who are at least eighteen (18) years old and currently residing in the Philippines. By using the Service, you represent and warrant that you meet these requirements and that the information you provide about yourself is true, accurate, and complete.
3. Your Account
You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us at hello@dailys.ph as soon as you suspect unauthorized access. We may suspend or terminate any account that we reasonably believe is being used in violation of these Terms or applicable law.
4. Quiz, Consultation, and Physician Relationship
The on-site quiz collects medical history relevant to hair loss treatment. Your responses are reviewed by a Philippine-licensed physician. A doctor-patient relationship begins only when a physician accepts your case at consultation — not at the moment you complete the quiz, book a consult, or place an order.
Our physicians exercise independent clinical judgement. They may decline to prescribe, request additional information, refer you to in-person care, or recommend an alternative treatment. Any clinical advice given through the Service is intended only for the patient who received it and must not be shared or relied upon by any other person.
5. Prescriptions and the Pharmacy Partner
If a prescription is issued, it is sent to our licensed Philippine pharmacy partner, which compounds and dispenses your medication and ships it to your address. Compounded medications are formulated to the patient's specific prescription and are not pre-registered as finished products with the FDA. Prescriptions issued through the Service are valid only within the Philippines and must not be re-sold or transferred to another person.
6. Subscriptions, Auto-Refill, and Cancellation
Most of our plans are sold as subscriptions. By starting a subscription, you authorize us to charge your selected payment method on each refill cycle until you cancel. You can cancel any time from your account or by emailing hello@dailys.ph; cancellation takes effect at the end of the current billing cycle, and you keep the meds you have already paid for in that cycle.
7. Pricing, Taxes, and Payment
Prices are shown in Philippine Pesos and include VAT where applicable. Payments are processed by our payment provider (PayMongo). We may change prices for future cycles with reasonable advance notice through email or your account.
8. Refund Guarantee
We offer a full refund, no questions guarantee on your first order if Dailys is not the right fit. Full conditions and the request process are in our Refund Policy, which is incorporated into these Terms by reference.
9. Shipping and Discreet Delivery
We ship to addresses within the Philippines. All packaging is unbranded for privacy. Estimated delivery times are best-effort and may be affected by courier or weather conditions. Risk of loss for medication passes to you upon delivery to the address you provided.
10. Telehealth Consent and Medical Disclaimer
Use of the Service is also governed by our Telehealth Consent and Medical Disclaimer, which are part of these Terms. The Service is not intended for emergencies. If you experience a medical emergency, call 911 or go to the nearest hospital.
11. Acceptable Use
You agree not to: (a) use the Service for any purpose that is unlawful or harmful; (b) impersonate any person or misrepresent your medical history; (c) interfere with the Service's operation or security; (d) reverse-engineer, scrape, or copy any part of the Service except as expressly permitted; or (e) re-sell, redistribute, or commercialize any prescription, content, or other material obtained through the Service.
12. Intellectual Property
All content on dailys.ph — including the Dailys name and logo, copy, design, photography, and software — is owned by Dailys or its licensors and protected by Philippine and international intellectual property law. We grant you a limited, personal, non-transferable license to use the Service for your own care; no other rights are granted.
13. Third-Party Services
The Service relies on third parties such as Shopify (storefront), PayMongo (payments), Calendly (scheduling), Resend (transactional email), and our pharmacy and courier partners. We are not responsible for the practices or content of these third parties beyond our contractual relationship with them.
14. Disclaimers
To the fullest extent permitted by Philippine law, the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. No statement on dailys.ph constitutes a guarantee of any specific clinical outcome — individual results vary.
15. Limitation of Liability
To the maximum extent permitted by the Civil Code of the Philippines and other applicable law, Dailys, its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the Service. Our aggregate liability for direct damages is limited to the amounts you paid Dailys in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded by law.
16. Indemnification
You agree to indemnify and hold Dailys, its affiliates, and partners harmless from any claim, loss, or expense arising out of (a) your breach of these Terms, (b) misuse of the Service, or (c) information you provided that was false, incomplete, or misleading.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. The parties will first try to resolve any dispute in good faith within thirty (30) days of written notice. If unresolved, the dispute will be referred to mediation or arbitration administered by the Philippine Dispute Resolution Center, Inc. (PDRCI) under its rules. The seat of arbitration is Metro Manila, the language is English, and the appropriate courts of the Philippines retain jurisdiction over any matter that cannot be arbitrated.
18. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Material changes will be communicated by email or in-app notice at least seven (7) days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
